Terms of Use

1. Eligibility and Your Account

You must be at least 18 years old and legally able to enter into an agreement to use Site Poster. You agree to provide accurate account information, keep your login credentials secure, and promptly notify us if you believe your account has been accessed without authorization. You are responsible for activity performed through your account.

2. Authorized Accounts and Connected Platforms

You may connect and use only websites, social-media accounts, pages, profiles, channels, and other third-party accounts that you own or are authorized to manage. Site Poster may connect with services such as Facebook, Instagram, LinkedIn, Blogger, Wix, and other supported platforms. Your use of those services remains subject to their own terms, policies, permissions, API rules, and restrictions.

3. Publishing and Scheduling

Site Poster provides tools that allow you to publish or schedule content to supported third-party platforms. You control the content, destination, timing, and publishing instructions you submit. You are responsible for reviewing your content and settings before publishing or scheduling it.

4. Your Content

You retain ownership of content you submit to Site Poster. You grant TM MARKETING LLC a limited, non-exclusive right to process, store, transmit, format, and deliver that content only as reasonably necessary to operate Site Poster and perform the actions you request. You represent that you have the rights and permissions necessary to use and publish the content you submit.

5. Acceptable Use

You agree not to use Site Poster for unlawful activity, unauthorized access to third-party accounts, infringement of intellectual-property rights, malware distribution, fraud, harassment, impersonation, spam that violates applicable law or platform rules, or attempts to interfere with or compromise Site Poster or its infrastructure. You may not reverse engineer, decompile, resell, copy, or redistribute the Site Poster software except where expressly permitted by applicable law or by written authorization from TM MARKETING LLC.

6. Third-Party Services and APIs

Site Poster depends on third-party services, APIs, authentication systems, websites, and networks that we do not control. These providers may change their APIs, permissions, policies, rate limits, features, availability, or access requirements at any time. As a result, a connected platform or Site Poster feature may be changed, interrupted, limited, or discontinued. We do not guarantee continuous availability of any third-party integration.

7. Subscriptions and Billing

Some Site Poster features may require a paid subscription. The applicable price, billing period, included features, and any usage limits will be shown when you subscribe. Unless otherwise stated at checkout, subscriptions renew automatically for successive billing periods until canceled. You authorize us and our payment provider to charge the payment method associated with your subscription for applicable recurring charges and taxes.

8. Cancellation and Refunds

You may cancel a paid subscription using the cancellation options made available through Site Poster or by contacting us. Cancellation stops future renewals and, unless otherwise stated, paid access continues until the end of the current paid billing period. Except where required by applicable law or expressly stated otherwise at the time of purchase, payments and renewal charges are non-refundable.

9. Account Suspension and Termination

We may suspend, restrict, or terminate access to Site Poster when reasonably necessary to protect the service, users, connected platforms, or third parties, or when we reasonably believe these Terms, applicable law, or third-party platform requirements have been violated. You may stop using Site Poster at any time.

10. Account and Data Deletion

You may request deletion of your Site Poster account and associated personal information by contacting us at info@tmmarketingllc.com. Additional information about retention, connected accounts, privacy rights, and deletion requests is provided in our Privacy Policy.

11. Site Poster Intellectual Property

Site Poster, including its software, design, branding, interface, original graphics, documentation, and other proprietary materials, is owned by or licensed to TM MARKETING LLC and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of Site Poster or its intellectual property to you.

12. Privacy

Your use of Site Poster is also subject to our Privacy Policy, which explains how we collect, use, store, protect, and delete information, including information associated with connected third-party platforms.

13. Service Changes and Availability

We may update, add, modify, limit, suspend, or discontinue Site Poster features when reasonably necessary, including in response to technical, security, business, legal, or third-party platform changes. Site Poster is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law.

14. No Guarantee of Publishing Results

We do not guarantee that every publishing or scheduling request will be accepted, displayed, indexed, remain available, or produce any particular result on a third-party platform. Publishing may fail or be delayed because of account permissions, platform restrictions, API changes, outages, rate limits, content rules, network conditions, or other circumstances outside our control.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, TM MARKETING LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, TM MARKETING LLC and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, business opportunities, goodwill, or content arising from or related to Site Poster. To the fullest extent permitted by law, our aggregate liability for claims relating to Site Poster will not exceed the amount you paid to TM MARKETING LLC for Site Poster during the twelve months immediately preceding the event giving rise to the claim.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless TM MARKETING LLC and its owners, officers, employees, and contractors from claims, liabilities, damages, losses, and reasonable costs arising from your content, your misuse of Site Poster, your violation of these Terms, or your violation of another person's rights.

18. Events Outside Our Control

We are not responsible for delay or failure caused by events reasonably outside our control, including internet or hosting outages, third-party platform failures, API interruptions, cyberattacks, natural disasters, government actions, labor disruptions, or widespread telecommunications failures.

19. Changes to These Terms

We may update these Terms as Site Poster, our business, connected platforms, or applicable requirements change. We will update the "Last updated" date when these Terms are revised. Your continued use of Site Poster after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

20. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. These Terms, together with the Privacy Policy and any additional terms presented for a specific subscription or feature, form the agreement governing your use of Site Poster.

21. Governing Law

These Terms are governed by the laws applicable to TM MARKETING LLC in the State of New Mexico, United States, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise.
